Claim Preparation

The preparation of a "claim" can serve a number of purposes. It may be to protect or preserve rights where others have caused delay or to recover the resulting costs.

An example of the preservation of a party's rights would be a claim for an extension of time as a defence to the imposition of liquidated damages. But time is money and the claim maybe for loss and expense to recover the costs incurred resulting from the delay.

The Practice can provide specialist assistance in the preparation and submission of a claim.

Contractual Problems

When a project runs according to plan, the contract document may never be referred to after it has been signed. When things go wrong, each word and phrase of the contract will be scrutinised in order to ascertain the facts.

If this happens, expert help is available to examine the conditions to establish where liability potentially lies, as opposed to what may be alleged. This will then determine the course of action required to dismiss the allegation, minimise the impact or pursue those responsible.

Examples include:

As commercial issues regarding progress or specification can be a major distraction to the project team, having a dedicated specialist to monitor and control these matters allows the management team to expedite completion of the works.

Post Contract Services

Many specialist sub-contractors in the construction industry do not employ full-time quantity surveyors to manage the financial or commercial aspects of a project. Conversely, a specific project may require additional dedicated resources.

Support and assistance can be provided as required in the monitoring of instructions, formulation of variations, the submission of monthly applications and the agreement of the final account.

Final Accounts

Large and complex Final Accounts can further distract management resources away from the administration of on-going projects.

The Practice offers a service whereby the documentation will be examined at our premises and a final account prepared based on the available information and discussions with the relevant personnel.

When the account has been submitted support will be provided in subsequent negotiations with the Employer or Main Contractor.
